El juez ha venido a indicar en la sentencia, que toda acusacion ha sido infundada y no tenía base alguna para formularse, pero en el tiempo que ha estado activa, la persona de Carlos Alberto Florez Cárdenas, ha sido objeto de todo tipo de especulaciones en todos los periodicos digitales del pais, acusandolo incluso antes de salir sentencia.

A mi al anterior y detallando por menor izada mente si el proceso de extradición en Colombia, permite entonces indicar con plena claridad que los documentos y pruebas que se remite a las autoridades colombianas por parte de Estados Unidos, no soportan una acusación directa sobre el ciudadano Carlos Alberto Flórez Cárdenas, pues ello sólo da paso a establecer ciertas situaciones, entre ellas la plena identificación del sujeto y con ello determinar que efectivamente sea ciudadano colombiano, asimismo que el delito no haya sido investigado en Colombia y que por este no curse una pena actual, luego entonces, como sea dicho a lo largo de esta providencia, los documentos allegados al dossier y que hicieron parte de las pruebas presentadas por parte del gobierno de los Estados Unidos al gobierno colombiano, permitieron avalar en su momento la extradición de Carlos Alberto Flórez Cárdenas, sin embargo estas piezas documentales lo demuestran con certeza la participación del citado es oficial en los hechos que generaron dicha solicitud de extradición, por tanto los documentos que hacen parte de este investigación, simplemente le indican este juez decir Linares hechos que son meramente subjetivos y que carecen de cimientos probatorios firmes que ahonde sobre una posible responsabilidad por parte del encartado frente a los hechos de materia de estudio.
Ahora bien, en relación a los testimonios allegados a lo largo del procedimiento, esto simplemente evidencian el procedimiento judicial adelantado por la policía Nacional de Colombia a través de la dirección de policía judicial, de cara al cumplimiento de la orden de captura confines de extradición que cursaba en contra de Carlos Alberto Flórez Cárdenas, pero en si no dirige a este juez disciplinario en forma coherente a establecer si efectivamente Carlos Alberto Flores Cárdenas se reunió con el abogado Villarraga, y mucho menos que motivó tal reunión o si dentro de esta de manera efectiva se entregaba información confidencial en referencia a las investigaciones adelantadas a los grupos al margen de la ley conocidos en autos, pues las piezas probatorias que obran dentro del dossier carecen de tal efectividad que permitan por lo menos objetivamente tener conciencia es que existió algún tipo de responsabilidad.
Conforme a lo anterior y de cara a la salvaguarda de los principios generales del derecho, es indispensable ahondar sobre los terrenos de la duda razonable imposible de eliminar, pues como se ha mencionado hasta la saciedad, las pruebas que obran dentro del proceso, lo demuestran en absoluto con efectividad la participación de Carlos Alberto Flórez Cárdenas en hechos contrarios a la ley, de contar con ello ha de decirse que el sentido de este fallo sería diferente, pero bajo esa premisa no podría fue fallar sanciona Torio mente la presente actuación pues para cumplir con esa característica de la norma jurídica se debe contar con pruebas que demuestren la responsabilidad del encartado en el hecho, circustancia que no se vislumbra en esta investigación, verbigracia, que como se indicó los documentos demuestran simplemente relatos de hechos que no cuentan con un cimiento probatorio que permita establecer claramente que los mismos se ajuste a la realidad, generando con ello dudas de imposible resolución.
En este sentido de fallo, y entendiendo el argumento jurídico que impulsa a este juez disciplinario a tomar a la presente decisión, debe ser respetuoso de los principios fundamentales del derecho, y en este orden de ideas la duda razonable imposible de eliminar debe ser resuelta a favor del disciplinado, Carlos Alberto Flórez Cárdenas, y pensamos en salvaguarda desde el principio, es que se actúa para no permitir dar paso a decir decisiones injustas y que pueden afectar seriamente derechos fundamentales de los funcionarios investigados.
RESUELVE
ARTÍCULO PRIMERO: disponer la terminación del procedimiento y en consecuencia decretar el archivo definitivo, de las diligencias que hacen parte de la investigación disciplinaria número redip-2010-16, seguida en contra del señor capitán Carlos Alberto Flórez Cárdenas, identificado con la cédula de ciudadanía 75.0 34.9 52 expedida en Neira, Caldas; al advertirse que no existen elementos de juicio que comprometan la conducta disciplinaria del funcional, y conforme a los puesto en el artículo 73 de la ley 734 de 2012, acorde a la parte activa del presente proveído.
Artículo segundo: por secretaría notificar la presente decisión al señor capitán Carlos Alberto Flores Cárdenas, identificado con la cédula de ciudadanía 75.0 tres 4.9 52 expedida en Neira, Caldas., Haciéndole saber que contra esta decisión procede el recurso de apelación ante el inspector General de la policía Nacional trámite que podrás realizar por intermedio de este despacho en los términos de los artículos 111,112 y 115 de la ley 734 de 2002, código único disciplinario.
ARTÍCULO TERCERO: surtido anterior y no habiendo sido recurrida la decisión de salutaciones correspondientes y archiven se las diligencias como antecedente en la inspección delegada especial de la dirección General, haciendo claridad que la misma hace tránsito a cosa juzgada, sin perjuicio a la acción penal o administrativa que por los mismos hechos diere lugar.
Como se puede leer en la sentencia, Carlos Alberto Florez Cárdenas queda libre de toda sospecha, aunque los medios digitales aun no han publicado nada que desmienta las primeras acusaciones sobre su persona.
